Article 3 – Applicability / General Provisions
1. These general terms and conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer.
2. Before the distance contract is concluded, the text of these general terms and conditions shall be made available to the consumer. If this is not reasonably possible, it shall be stated, before the distance contract is concluded, that the general terms and conditions are available for inspection at the trader’s premises and will be sent free of charge as soon as possible at the consumer’s request.
3. By accepting an offer and/or placing an order, the buyer accepts that these terms and conditions apply.
Article 4 – The Offer
1. If an offer is valid for a limited period or is subject to conditions, this will be expressly stated in the offer.
2. The offer contains a complete and accurate description of the products and/or services on offer. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer. Where the trader uses images, these are a true representation of the products and/or services offered. Obvious mistakes or errors in the offer are not binding on the trader.
3. Every offer must contain sufficient information to make it clear to the consumer what rights and obligations are attached to the acceptance of the offer.
Article 5 – The agreement
1. Subject to the provisions of paragraph 4, the contract is concluded at the moment the consumer accepts the offer and fulfils the conditions set out therein.
2. If the consumer has accepted the offer by electronic means, the trader shall immediately confirm receipt of the acceptance of the offer by electronic means. Until such time as the trader has confirmed receipt of this acceptance, the consumer may withdraw from the contract.
3. Where the contract is concluded electronically, the trader shall take appropriate technical and organisational measures to secure the electronic transmission of data and shall ensure a secure web environment. Where the consumer is able to pay electronically, the trader shall observe appropriate security measures in this regard.
4. The trader may – within the limits of the law – ascertain whether the consumer is able to meet their payment obligations, as well as all those facts and factors that are relevant to the responsible conclusion of the distance contract. If, on the basis of this investigation, the trader has good grounds for not entering into the contract, they are entitled to refuse an order or enquiry, stating their reasons, or to attach special conditions to its performance.
5. The trader shall provide the consumer with the following information together with the product or service, either in writing or in such a way that the consumer can store it in an accessible manner on a durable medium:
A. The email address of the trader to whom the consumer may address any complaints: klantenservice@zie-zo.com
B. the conditions under which and the manner in which the consumer may exercise the right of withdrawal, or a clear statement that the right of withdrawal is excluded;
C. information on warranties and existing after-sales service;
D. the information set out in Article 4(3) of these terms and conditions, unless the trader has already provided this information to the consumer prior to the performance of the contract;
E. the requirements for terminating the contract where the contract has a term of more than one year or is of indefinite duration.
F. In the case of a long-term transaction, the provision in the previous paragraph applies only to the first delivery.
Article 6 – The price
1. Until the contract has been concluded, the trader is entitled to amend prices, offers and other terms and conditions. Buyers cannot derive any rights from prices and offers from the (recent) past;
2. The prices quoted in the range of products or services include 21% VAT and exclude delivery charges;
3. The delivery charges applied to every order for deliveries within the Netherlands and Belgium are listed under the heading ‘Delivery times & delivery charges’ and are clearly displayed at the checkout.
4. Obvious errors or mistakes in the offer are not binding on the trader.
Article 7 – Delivery and Performance
1. The trader shall exercise the utmost care when accepting and fulfilling orders for products and when assessing requests for the provision of services.
2. The place of delivery shall be the address that the consumer has provided to the company.
3. The trader endeavours to dispatch orders within 1–3 working days, but no later than 30 days after receipt of payment, unless a longer delivery period has been agreed. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer will be notified of this no later than 30 days after placing the order.
4. The trader shall not be liable for delays caused by postal and parcel delivery services.
5. The trader shall not be liable for any loss or damage whatsoever resulting from the announced delivery times being exceeded.
6. If it proves impossible to deliver an ordered product, the trader will endeavour to provide a replacement item. No later than upon delivery, it will be clearly and comprehensibly stated that a replacement item is being supplied. The right of withdrawal cannot be excluded in the case of replacement items. The costs of any return shipment shall be borne by the trader.
7. The risk of damage to and/or loss of products remains with the trader until the moment of delivery to the consumer or to a representative designated in advance and notified to the trader, unless expressly agreed otherwise.
Article 8 – Complaints, Returns and the Right of Withdrawal
1. The trader will do everything in its power to supply you with a good product. We recommend that you inspect the items delivered immediately upon receipt. Should the items ordered not meet your expectations, you must inform us of this as soon as possible. The trader will then endeavour to resolve any issues or complaints in consultation with the buyer and in the best possible way.
2. During the cooling-off period, the consumer shall handle the product and its packaging with care. He shall only unpack or use the product to the extent necessary to assess whether he wishes to keep it. If the consumer exercises their right of withdrawal, they shall return the product to the trader with all accessories supplied and – where reasonably possible – in its original condition and packaging, in accordance with the reasonable and clear instructions provided by the trader.
3. The buyer is entitled to return the items supplied by the trader within 14 days of the end of the statutory 14-day cooling-off period. During the 14-day cooling-off period, the buyer must handle the items and their packaging with care. The buyer shall only unpack or use the product to the extent necessary to assess whether they wish to keep it.
4. The costs of returning the goods are to be borne by the buyer.
5. Items may be returned in their original packaging. The buyer is responsible for paying the associated postage costs.
6. Provided the items are unused and undamaged and have been returned correctly and in good time, the trader shall refund the price paid, including delivery costs, no later than 14 days after receipt of the returned items. In this context, ‘unused and undamaged’ also includes damage caused by the smell of cigarette smoke, perfume or other clearly detectable odours.
Article 9 – Payment
1. The contract of sale is concluded at the moment you accept the offer and fulfil the conditions set out therein. Until receipt of this acceptance has been confirmed by email, the customer may withdraw from the contract.
2. The consumer is obliged to notify the trader immediately of any inaccuracies in the payment details provided or stated.
3. Consumers can choose from the following payment methods: iDeal, Bancontact, Klara and Riverty.
Article 10 – Complaints Procedure
1. Consumers may submit complaints to the trader by email.
2. The trader has a complaints procedure that has been adequately publicised and handles the complaint in accordance with this complaints procedure.
3. Complaints regarding the performance of the contract must be submitted to the trader within a reasonable time, in full and clearly described, after the consumer has identified the defects.
4. Complaints submitted to the trader shall be answered within 14 days of the date of receipt. If a complaint is likely to take longer to process, the trader will respond within the 14-day period with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed reply.
5. Consumers may also refer a dispute to the Disputes Committee via the ODR platform (http://ec.europa.eu/consumers/odr/)
Article 11 – Liability
1. Any liability on the part of the trader and in respect of the trader’s products for any damage whatsoever, whether direct or indirect, is excluded. Nor shall the trader be liable for any damage caused by third parties in the performance of the contract.
2. The trader accepts no liability for any damage arising from the use of the trader’s products.
3. The trader’s liability is always limited to a maximum of the purchase price of the item in question.
4. In the event of misunderstandings, distortions, delays or the failure of orders and communications to be properly transmitted as a result of the use of the Internet or any other means of communication in the correspondence between you and the trader, or between the trader and third parties, in so far as they relate to the relationship between you and the trader, the trader shall not be liable, unless there is evidence of wilful misconduct or gross negligence.
